In light of the UK’s policy paper on AI regulation being unveiled this summer and the EU’s continuing efforts to tackle the same question, it is time to examine the status quo of AI liability, especially regarding trademark infringements. This article examines the existing liability regimes as well as the case law on trademarks and analyses their suitability for AI systems.
