This summary is based on the paper ‘Flipping the paradigm of weak patent rights: from theories to evidence’ by Annika Bichlmayr and Cecilia Maronero recently published (Journal of Intellectual Property Law & Practice, Volume 19, Issue 3, March 2024, Pages 256–277, https://doi.org/10.1093/jiplp/jpad118). In the article, the authors discuss anti-patent advocacy and several subtle policy proposals aimed at weakening the patent system. Using empirical evidence, they highlight the flaws and harmful effects of such efforts.
