Michele Herman

Michele founded JusTech Law, PLLC in 2016 to provide services focusing exclusively on legal and business issues affecting technology development and commercialisation.

Previously, Michele provided strategic counsel and negotiated complex IP transfer and licensing deals for several new technology companies spun out by The Invention Science Fund, an Intellectual Ventures innovation fund, where Michele served as Chief Counsel. Michele was also a partner at Davis Wright Tremaine, LLP and Woodcock Washburn, LLP focusing on technology standards, open source software, and technology and patent licensing. Michele also formed and managed both the Corporate Standards Strategy and Intellectual Property Strategy teams at Microsoft, where she held several positions including that of Associate General Counsel in Microsoft’s IP and Licensing Group, and Senior Director of Intellectual Property Strategy.

Michele has unique expertise negotiating numerous complex intellectual property policies for standards setting organisations involving multiple parties and has been instrumental in the creation of several standards setting organisations and other technical development communities. Michele currently represents a number of technology communities as well as clients participating in such communities. She has served as an expert in litigation relating to Standards Essential Patents.

Michele has been an adjunct professor at Seattle University School of Law and has guest lectured on numerous occasions at University of Washington’s School of Law on both standards and open source software. Michele has also held several leadership roles on licensing, standards and open source committees in organisations such as the ABA Section of Science and Technology Law, AIPLA and IPO. Michele was a significant contributor to the ABA’s Standards Development Patent Policy Manual and has published numerous articles on licensing, standards, and open source software. She received her B.S. in Electrical Engineering from Rutgers University (with high honors), her J.D. from Rutgers University School of Law (with honors), and is registered to practice before the US Patent and Trademark Office.
